The modern, form- and context-based zoning code is among the first of its kind in the United States, and implements the all-encompassing citywide plan set forth in Blueprint Denver. The code ensures a predictable public realm by regulating the physical shape, mass and façade of buildings. The former zoning code was inconsistent with the city's vision, and created obstacles to sustainable, responsible development. After extensive public input over five years — including focus groups, hundreds of community meetings, community feedback on drafts of the code, and over 35,000 individual citizen participants — Denver City Council approved the code's text and map on June 25, 2010. Denver's zoning code takes into account Denver's past, present and future. It preserves historic districts and structures, promotes maintaining the character of established neighborhoods (areas of stability), and channels growth to areas that could benefit from revitalization (areas of change), such as transit station areas. The economic downturn of recent years slowed the pace of building projects in Denver, but the Community Planning and Development Department has seen permitting on the rebound of late. "Denver is poised for economic recovery because we have a zoning code that's clear, predictable and easy to use," said Molly Urbina, interim manager of Denver Community Planning and Development. "As development picks up again, we're ready." One effect of the new zoning code map has been a drastic reduction in rezoning requests. In 2008, for example, 52 properties in Denver were rezoned at property owners' request. In 2011, only 21 rezonings occurred; 11 of those were properties that were not included in the 2010 citywide rezoning. The code has helped to transform some communities, notably East Colfax, where it has played a role in creating a real "main street." Current and planned buildings under the new "main street" zoning on Colfax include Phoenix on the Fax (7171 E. Colfax), 7-11 (7675 E. Colfax), Argonaut Liquors (760 E. Colfax) and Sunflower Market (Colfax at Garfield). Each building meets the code's form guidelines that ensure ground-floor activation to promote a safe, active, and pedestrian-scaled commercial street. According to the Fax Partnership association, there is an estimated $434 million in new development and building renovations in the pipeline for Colfax. Proactive rezoning also removed barriers to redevelopment of transit station areas throughout the city. Development is progressing at station sites like Alameda, Evans, 38th & Walnut, and 10th & Sheridan. The Urban Land Conservancy estimates that the Evans station alone will generate more than $5.6 million in local income and at least 67 local jobs. [CPN] INC Zoning minutes for June 23.2012
ZONING AND PLANNING COMMITTEE MINUTES – June 23, 2102

The INC Zoning and Planning (ZAP) Committee met on June 23 at the (former) Emerson School at 1420 Ogden Street, which opened in May as the new joint headquarters for the Colorado chapter of the National Trust for Historic Preservation, Historic Denver and Colorado Preservation, Inc. Rosemary Stoffel, a ZAP member and Historic Denver board member, explained the history and re-use of the Denver-landmarked building, designed by Robert Roeschlaub, which opened as an elementary school in 1885. Approximately $3.5 million was donated and spent to renovate and re-use the building. Thanks to Rosemary and the 3 groups for allowing us to see the fine old building, which has served the Capitol Hill neighborhood for 137 years.
Michael Guiietz, president of Jefferson Park United Neighbors, spoke about a Block Party at West 25th Avenue and Eliot Street taking place today where several vacant storefronts will be temporarily used for "pop-up" stores and neighbors will be encouraged to brainstorm about how the area can be re-vitalized for community-serving uses. He also informed the committee about a discussion with officials of Sports Authority Field about the degree of lighting (lumens) recently announced by the officials for the proposed new signs at the field. Denver's Zoning Administrator, Michael O'Flaherty, described the city ordinance which prohibits "glare," which is not easy to enforce.
Michael O'Flaherty then presented a map (as of June 1, 2012), indicating the sites of shelters, community correctional facilities and "large residential care uses." He and Michael Henry described the 1993 complicated ordinance which requires spacing between such facilities to prevent over-saturation of neighborhoods with such facilities, for the benefit of the neighbors and the residents of such facilities. However, all of the facilities which existed in 1993 are "grandfathered" in their locations. Some committee members commented that the limitations of the definitions of such facilities are unclear and encouraged the city to inspect such facilities periodically to ensure that they are operating in compliance with the definitions of the ordinance and that their operations are as originally presented in the applications for each facility. Some committee members also suggested that neighbors can try to develop good-neighbor agreements with operators of such facilities. The city must give notice to registered neighborhood organizations of each application for a new shelter, community correctional facility or large residential care use (9 or more residents). District 8 City Councilman Albus Brooks commented on the city's efforts to locate and designate locations in government and non-profit buildings and churches for temporary emergency shelter beds. City recreation centers are currently being considered for such uses. He and Michael O'Flaherty assured the committee that registered neighborhood organizations will be involved in the discussions.
Molly Urbina, Manager of the Denver Community Planning and Development Department, and Principal City Planner Tina Axelrad discussed with the committee the relationship of the city's process for developing neighborhood plans or area plans and zoning. In particular, they stressed that discussion of economic development or return on investment will be considered in the planning process, but that those are not factors or criteria for determining whether rezoning applications will be approved by City Council. The ZAP committee had discussed this in April and was and is very concerned that economic considerations should not be used as criteria for rezoning, at least without a broad citywide discussion. Wayne New of Cherry Creek North Neighborhood Association gave some background about the ongoing Cherry Creek Area Plan process, in which economic considerations were considered and the issues that resulted between neighbors, residents and planners.
There was brief discussion about the proposed Walmart store near East 9thth Avenue and Colorado Blvd. and also the possible redevelopment of the Buckley annex at East 1st Avenue and Quebec and the existing general development plans (GDPs).for both of those areas.
The committee discussed and agreed to update the committee's mission statement as follows:

The mission of the INC Zoning and Planning Committee is to learn about zoning, planning, licensing and urban design issues and processes in Denver, including sidewalks and tree lawns; to assist neighborhood groups in dealing with such matters; and to provide advocacy, recommendations and comments to city government, with emphasis on the need for and importance of involvement of neighbors and neighborhood organizations in city issues.

Denver Pools pitch in to “Beat the Heat” with weekend special
Kids under 18 swim free, adult admission just $1
DENVER, CO — Denver Parks and Recreation, with support from with Mayor Michael B. Hancock’s office, today announced that starting Sunday, July 1,2012, admission to the 16 Denver outdoor pools on Saturdays and Sundays will be free for Denver youth under the age of 18 and just $1 for Denver adults 18 and over. This program will run every Saturday and Sunday from July 1 through the end of the 2012 Denver outdoor pool season, which is scheduled for August 12.
“This is the right thing for us to do to help citizens cope with the unseasonably hot weather we are experiencing,” said Lauri Dannemiller, Manager of Denver Parks and Recreation. “Making our pools more accessible on the weekends will provide more opportunities for kids and families all across Denver to stay cool during this hot summer.”
“It’s critical that we create every opportunity for our children and their families to enjoy healthy activities together,” said Denver Mayor Michael B. Hancock. “Denver’s swimming pools throughout the City are great places for families to beat the heat during this hot summer.”
Denver Parks and Recreation will make sure to appropriately staff all pools to provide a safe environment at each pool to handle the maximum capacity allowed by safety code. On weekends, as on weekdays, Denver Parks and Recreation will not allow more people into the pools or pool areas than what is allowed by the established safety regulations.

In Plain English: The Affordable Care Act, including its individual mandate that virtually all Americans buy health insurance, is constitutional. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding. On that question, the Court held that the provision is constitutional as long as states would only lose new funds if they didn't comply with the new requirements, rather than all of their funding.

[CPN] Cabinet in Community: Postponed!
Hi, Friends,
Our Cabinet in the Community meeting that was scheduled for this Saturday, June 30th, has been postponed in order to honor fallen Police Officer Celena Hollis, who was shot and killed in the line of duty on Sunday evening. Mayor Michael B. Hancock and City Officials plan to attend her funeral service on that day.
The Mayor has asked the entire City and County of Denver to keep this fallen officer, her daughter, family and loved ones in their thoughts and prayers. These moments are never easy, he said, and we remain saddened by this great loss to our community and city family. Our officers have lost a comrade and a friend, and our residents have lost an advocate for peace and justice.
This is a tragedy for all of us, the mayor said, but make no mistake: We will not surrender our city to this specter of senseless and needless violence. We must stand united, hold true to safeguarding our streets, neighborhoods and residents and maintain the high level of safety throughout Denver.
The city's commitment to the Cabinet in the Community remains, and we look forward to meeting at the Rude Park Recreation Center later this summer. The new date to put in your calendar is Aug. 18, 2012. Please share this information with your friends, family and colleagues.

Help! With all the cool reports from riders around the country, I have a weak problem. Has anyone found a source for a satisfactory motorcycle tire repair?
Picked up a nail in an essentially new rear tire. Nice, clean puncture in the tread area. Tire too good to pitch. Need good, solid plug/patch as temps will be high. Anyone know a good repair shop?
